DWI & driving

DWI: keep both paths in view.

Court release and driving privileges are separate processes. Keep the paperwork and next steps for each.

Release, appearances & conditions

Keep your release order and ask your attorney to explain appearances, testing, monitoring and any bail option. Do not remove a monitor or stop testing without an authorized change.

License status & reinstatement

Posting bail does not authorize driving. Check your DVS notices and exact license requirements before you drive or arrange interlock installation.

Ask an attorney promptly about deadlines. Under Minnesota Statutes §169A.53, judicial review of a test-failure or refusal revocation generally must be requested within 60 days after receipt of notice. Do not wait for the criminal case to resolve. Read the statute ↗

A practical preparation list

  1. Save the DVS notice, court paperwork and the dates you received them.
  2. Arrange a licensed driver or other transportation while your authorization is uncertain.
  3. Ask DVS which forms, fees, assessment or insurance documents apply to your record.
  4. If interlock is required, follow DVS’s current enrollment sequence and certified-provider instructions.
  5. Confirm license authorization, ongoing compliance and removal requirements directly with DVS.
